Versacore Tech Designs Service Agreement (Updated)

This Versacore Tech Designs Service Agreement ("AGREEMENT") is made and entered into by and between you ("CUSTOMER" or “You”) and Versacore Tech Designs (“Versacore Tech Designs”) for the use of and services related to the rental of digital Versacore Tech Designs services (the "Versacore Tech Designs") in accordance with the following terms and conditions set forth herein.

1. Compliance with Law

CUSTOMER agrees that CUSTOMER will not use Versacore Tech Designs premises or any Versacore Tech Designs services for any unlawful, illegitimate, or fraudulent purpose or for any purpose prohibited by Canada Postal regulations. CUSTOMER further agrees that any use of the Versacore Tech Designs shall be in conformity with all applicable federal, provincial, and local laws.

2. Confidentiality

This AGREEMENT shall remain confidential, except that this AGREEMENT may be disclosed upon written request of any law enforcement or other governmental agency, or when legally mandated. Upon request, the CUSTOMER agrees to complete all necessary documents, and any required acknowledgment form relating to the service of process. CUSTOMER further agrees to sign an updated version of this AGREEMENT upon request.

3. Authorization

Possession of the Versacore Tech Designs username and password shall be considered valid evidence that the possessor is duly authorized to remove any contents from the Versacore Tech Designs. In the event of death or incapacity of the CUSTOMER, Versacore Tech Designs will require the appropriate documents from the Probate Court, the executor of the estate, the trustee, or other similar person or entity before releasing mail or packages to a requesting party.

4. Fees and Billing

Versacore Tech Designs service fees are all due and payable in advance and CUSTOMER agrees that Versacore Tech Designs may hold mail and packages pending payment. There will be no pro-rations or refunds for the cancellation of any service. CUSTOMER agrees to pay a late fee of $25.00 if any payment is not received within five (5) days of when due. Versacore Tech Designs service fees and other related fees stated herein are subject to change. In the event that CUSTOMER receives an unreasonable volume of mail or packages at Versacore Tech Designs according to Versacore Tech Designs’s reasonable judgment, Versacore Tech Designs may require CUSTOMER to upgrade to a larger size mailbox and/or pay any additional charges. Versacore Tech Designs reserves the right to increase service fees in the event that CUSTOMER adds additional individuals or entities to those authorized to receive mail and packages.

5. Mail Handling After Termination

Upon expiration, cancellation, or termination of this AGREEMENT, Versacore Tech Designs will:
a. Store mail or packages for up to six (6) months provided the CUSTOMER pays a storage fee of $50.00 per month, plus a handling fee per pickup.
b. Retain CUSTOMER's mail (other than Unsolicited Mail) for ten (10) days if no forwarding fees and forwarding address are provided. After that, items may be discarded, destroyed, or returned to sender.
c. Discard or destroy any “Unsolicited Mail” (e.g., bulk mail, occupant/resident mail, coupons, advertising, or other promotional material).
d. Refuse any package addressed to CUSTOMER delivered by any party, including commercial couriers.

6. Right to Refuse or Discard Mail

Upon cancellation or termination of this AGREEMENT, Versacore Tech Designs may:
a. Refuse any mail or package addressed to CUSTOMER.
b. Discard, destroy, or Return to Sender any mail or package remaining at Versacore Tech Designs.

7. Term

The term of this AGREEMENT shall be the initial period paid for by the CUSTOMER and any renewal period thereafter. Renewal shall be at Versacore Tech Designs’s sole discretion.

8. Termination by Versacore Tech Designs

Versacore Tech Designs may terminate this AGREEMENT for good cause at any time with thirty (30) days written notice. Good cause includes but is not limited to:

Abandonment of the mailbox;

Use of the service for unlawful, illegitimate, or fraudulent purposes;

Failure to pay monies owed when due;

Excessive mail or package volume;

Offensive or disruptive behavior toward other customers or staff;

Violation of any provision of this AGREEMENT.
Actions of authorized users are deemed actions of the CUSTOMER.

9. Notices

Any written notice to CUSTOMER shall be deemed delivered twenty-four (24) hours after placement in CUSTOMER's mailbox or upon personal delivery. For termination due to abandonment, notice shall be deemed delivered one day after placement with a commercial courier or five (5) days after placement in Canada Post by Registered Mail, whichever is earlier.

10. Acceptance and Delivery

As CUSTOMER's authorized agent for receipt of mail, Versacore Tech Designs will accept all mail, including registered, insured, and certified items. Unless prior arrangements have been made, Versacore Tech Designs shall only be obligated to accept mail or packages delivered by commercial courier services requiring a signature. CUSTOMER must sign for all mail and packages upon request. Packages not picked up within three (3) days of notification will incur a $5.00 per day storage fee. If CUSTOMER refuses any mail or package, Versacore Tech Designs may return it to sender at CUSTOMER’s expense. C.O.D. items will be accepted only with prior payment arrangements.

10.1. Policy on Mail Marked “Do Not Forward”

Versacore Tech Designs strictly complies with Canada Post and federal regulations concerning mail endorsed “Do Not Forward”, “Return to Sender if Undeliverable”, or any similar restriction.

Legal Basis: Under the Undeliverable and Redirected Mail Regulations (C.R.C., c. 1298, s. 8.2), any item of mail bearing such an endorsement must be treated as undeliverable and may not be redirected or forwarded.

Policy:
a. Versacore Tech Designs will not forward any mail displaying these endorsements, even at the CUSTOMER’s request.
b. When such mail is received, Versacore Tech Designs will notify the CUSTOMER by email.
c. The CUSTOMER may elect to pick up the mail in person or authorize a Return to Sender.
d. If no response is received within ten (10) days, the mail will be returned or disposed of per standard procedures.

Reasoning: This policy protects the privacy and legal rights of both senders and recipients, ensures compliance with postal law, and maintains the integrity of Versacore Tech Designs as a registered mail agent.

Acknowledgment: By accepting this AGREEMENT, CUSTOMER understands that Versacore Tech Designs cannot override a sender’s “Do Not Forward” instruction and agrees not to hold Versacore Tech Designs liable for non-forwarding of such mail.

11. Indemnity

CUSTOMER agrees to protect, indemnify, defend, and hold harmless Versacore Tech Designs, its affiliates, officers, directors, agents, and employees from any and all losses, damages, claims, liabilities, or costs arising out of the use or possession of the Versacore Tech Designs services, including loss or delay by Canada Post or courier, or damage to mail or packages by any cause whatsoever.

12. Limitation of Liability

CUSTOMER agrees that the total amount of liability of Versacore Tech Designs, if any, for all claims shall not exceed $100.00, regardless of the nature of the claim.

13. Address Accuracy

CUSTOMER must use the exact mailing address provided by Versacore Tech Designs without modification. Misaddressed items are not the responsibility of Versacore Tech Designs.

14. Use Restrictions

CUSTOMER agrees not to use this address for the purpose of establishing Google AdSense or Google Maps listings.

15. Identification Requirements

Delivery by courier must be to Versacore Tech Designs’ street address only. Upon signing this AGREEMENT, the CUSTOMER shall provide two valid forms of ID, one with a photograph.

16. Legal Waiver

By agreeing below, CUSTOMER waives the right to bring legal action against Versacore Tech Designs for any reason related to the normal provision of services and agrees to abide by all applicable laws and regulations.

17. Indemnification

The CUSTOMER shall indemnify and hold harmless Versacore Tech Designs, its affiliates, and its respective officers, directors, agents, and employees from any claims or costs arising from use of the services under this AGREEMENT.
